Club de Mar: Dispute over boat mooring rights

Palma’s Club de Mar, located at the western end of the Paseo Marítimo, just 500 meters from the cruise terminal and the Porto Pi shopping center, is causing controversy: a decree is set to prohibit concessionaires from selling or renting their boat moorings.

As reported by the Mallorcazeitung (MZ) in an article on September 1, discontent is spreading among long-standing members of Palma’s Club de Mar, the exclusive sports and leisure marina in the immediate vicinity of Porto Pi (which is still undergoing renovation).

Club de Mar under pressure

What is it all about? According to the MZ, many investors, including some Germans, feel cheated out of their investment in a berth. Several years ago, investors purchased concessions for a berth that were still valid for two years at the time. Five years ago, as described in one example, this concession was then renewed for a further 25 years at a price of €150,000. The club agreed to a five-year holding period due to the renovation.

This meant, according to mallorcazeitung.es, that in the case described, the berth could only be used by the club itself until May 2025 and could not be resold or sublet. However, “shortly before the expiry of this holding period, a letter from the Ports de Balears port authority arrived,” stating that despite the expiry of the holding period, there were no plans to rent or sell the berth.

The club officials then presented the members with three options for how to proceed: the first was to use the berth themselves, the second was to wait and see what the negotiations between the Club de Mar and Ports de Balears on the matter would yield, and the third was to have the berth reversed – “at the price the members paid five years ago,” according to the MZ.

Mallorcazeitung.es quotes an affected German, who has not owned a boat himself for some time and who regarded the berth in question as an investment, as saying: “That’s… not an attractive option, because firstly, the value of berths has skyrocketed in recent years, and secondly, the Club de Mar only guarantees payment within two years, with the option of waiting another two years if sufficient funds are not available.”

Some concessionaires would describe the treatment of the Club de Mar as “very unfair”; they would now seek a class action lawsuit if Club de Mar remained adamant, according to the MZ. Anyone wishing to join this lawsuit can register at red@mallorcazeitung.es.
